Recipient Created Tax/Payment Invoices
In most cases, tax invoices are issued by a supplier. However, in special cases, Bing Han International Australia, as the recipient of the goods or services, may issue a tax invoice for your services. This is known as a recipient-created tax invoice (RCTI). It is for suppliers who are registered for GST when the invoice is issued. If you are not registered for GST and you will be issued a recipient-created payment invoice (RCPI).
The rules apply to RCTI and RCPI, where:
Supplier - is the Independent Distributor
Supplies - is the provision of services for which rebates or bonuses are paid
Recipient - is Bing Han International Australia
RCTI - is Recipient-Created Tax Invoices
RCPI - is Recipient-Created Payment Invoices
ABN - is Australian Business Number
GST - is the goods and services tax
Tax Invoice - includes an adjustment notice
Payment Invoice - includes an adjustment notice
- Recipient can issue an RCTI if:
- the supplier is registered for GST
- the supplier agree that the recipient can issue an RCTI in respect of the supplies
- the supplier will not issue tax invoice in respect of the supplies
- the agreement is current and effective when recipient issue the RCTI
- the goods or services being sold under the agreement are of the type that ATO has determined can be invoiced using an RCTI
- the recipient is not required to make payment of GST to the extent that the supplier’s liability to make a payment for GST to the ATO has ceased
Recipient’s written agreement can either be a separate document specifying the supplies, or recipient can embed this information or specific terms on the tax invoice. The above terms are modified in accordance with current Goods and Services Tax Rulings as required for the issuance of a RCTI from time to time. If for any reason the supplier’s liability to GST in respect of any supplies made by it under the Agreement is increased or reduced, then the amount paid by the recipient in respect of that Supply must be increased or decreased (as the case may require) by a similar amount. The recipient will stop issuing RCTIs once any of the requirements for issuing RCTIs are no longer met.
- Recipient can issue an RCPI if:
- the supplier has quoted their ABN but is not registered for GST, or
- the supplier has not quoted their ABN but signed the “Statement by a supplier” form and submitted it to the recipient to keep for 5 years
- the supplier agrees that the recipient can issue RCPI in respect of the supplies
- the supplier will not issue payment invoice in respect of the supplies
- the agreement is current and effective when recipient issue the RCPI
- the goods or services being sold under the agreement are of the type that ATO has determined can be invoiced using a compliant payment invoice
Recipient’s written agreement can either be a separate document specifying the supplies, or recipient can embed this information or specific terms in the payment invoice. If for any reason the supplier’s liability to the payment in respect of any supplies made by it under the agreement is increased or reduced, then the amount paid by the recipient in respect of that supply must be increased or decreased (as the case may require) by a similar amount. The recipient will stop issuing RCPIs once any of the requirements for issuing RCPIs are no longer met.
